Living Healthy, LLC (“we”, “our” and “us”) respects our customers and understands that you are concerned about privacy. We have posted this Privacy Policy to let you know what kind of information we collect, how it is handled and with whom it may be shared. As we continue to develop our website (“Site”) and take advantage of technologies to improve the services we offer, this Privacy Policy will likely change. We encourage you to refer to this Privacy Policy on an ongoing basis so that you understand the current policies that apply to the information you provide to us.

We reserve the right to change or update this Privacy Policy by posting such changes or updates to the Site. Amendments to this Privacy Policy will be posted at this URL and will be effective when posted.  It is your responsibility to review any such changes or updates and check the website from time to time to be sure you understand all terms and conditions, agreements and policies of the Site and are in compliance with them. You can tell when this Privacy Policy has changed by checking the “Date Last Updated” that appears at the end of this Privacy Policy. Your continued use of the Site following the posting of any amendment, modification or change shall constitute your acceptance thereof.

1. Applicability of this Privacy Policy

This Privacy Policy applies to all information collected by us through the Site. Although the Site may provide links to third-party websites, such third party websites are not covered by this Privacy Policy. These links are provided for your convenience only, and we assume no responsibility for the privacy or security of information you provide to any third party through linked websites or any other means. “Third Parties” mean any person or entity other than us and you.

2. What Information Company Collects

Non Personally Identifiable Information

Our  web server collects non-personally identifiable information (“NPII”) from you during the course of your visit to the Site. NPII is not associated with you as an individual. It is measured anonymously and only in the aggregate. This information may include general information regarding your Internet Service Provider and host, your IP address, the content on the Site you access, the platform operating system and web browser you use, and the date, time, and duration of your visit to the Site.

NPII may be collected through the use of a “cookie.” Cookies are small text files that are stored on your hard drive to store your preferences. Cookies themselves do not contain any personally identifiable information. You can choose to refuse any cookie by following the procedure suggested by your particular web browser. You may delete our cookies from your computer, but doing so may impair your use of the Site.

We may also use “web beacons” on the Site from time to time. Web beacons are small pieces of code placed on a web page to track or monitor the behavior of users and collect data about the visitors viewing a web page. For example, web beacons can be used to count the users who visit a web page or to deliver a cookie to the browser of a visitor viewing that page.

We may also use certain statistical analysis services, such as Google Analytics, to generate statistics in the aggregate about visitors to the Site. Google Analytics is a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies to analyze how users use the Site.

Personally Identifiable Information

We may also collect personally identifiable information (“PII”) from you through your voluntary submission to us. For instance, such information may be submitted through your use of an online form to register with us to access and use certain portions of the Site, or by sending us an email to request certain services from us. You may also give us PII when submitting a résumé and/or an employment application. In other cases, such information may be the content or information you post in a web-forum, in a chat room, or through other interactive or “social networking” portions of the Site (collectively referred to herein as the “Interactive Portions ” of the Site). The information you voluntarily submit may include information which may be used to personally identify you, such as your name, physical address, telephone number, e-mail address, credit card number, and/or tax identification number.

Location Information

When you visit our Site on your mobile device, we may use collect information about the location of your mobile device using various location tracking technologies such as GPS, Wi-Fi, cell tower proximity, or other similar technology to determine your current location in order to provide you with advertisements or other offers or services that may be of interest to you. Additionally, we may use such information in the aggregate for our business purposes. Most mobile devices will enable you to disable location services. Please contact your mobile device provider or manufacturer if you are uncertain as to how to disable such services.

3. How We Use the Information We Collect

We use information we collect to, among other things:  process your requests and transactions;  offer or furnish additional services;  personalize the types of information you receive from us;  assess trends in the use of the Site; develop content and functionality that helps serve our users’ needs;  and improve the services we provide.

4. How We Share the Information We Collect

Personally Identifiable Information

We do not share your PII with Third Parties,  except as described below.

We may disclose your PII, including credit card and/or financial information, to Third Parties that help us bring you the products and services we offer and to create, operate, and maintain our Site. For example, we may work with Third Parties to: (a) manage a database of customer information; (b) assist us in distributing e-mails; (c) assist us with direct marketing and data collection; (d) provide data storage and analysis; (e) provide fraud prevention; (f) provide customer service; (g) provide product fulfillment and shipping services; and (h) provide other services designed to assist us in developing and running our Site and maximizing our business potential. We require that these Third Parties agree to keep all information shared with them confidential and to use the PII only to perform their obligations to us.

In the event we sell or transfer all or a portion of our business or assets, or otherwise undergo a change in control, your PII will likely be among the assets sold or transferred. Should such an event occur, we will use reasonable efforts to direct the transferee to use PII in a manner that is consistent with this Privacy Policy, but we cannot be responsible for the actions of any Third Party that may purchase our business or assets.

PII contained in résumés and other materials submitted by job applicants is used for applicant screening and hiring purposes and for general human resource related purposes.

Non-Personally Identifiable Information

Our use of the NPII we collect through the Site is unrestricted. We sell or license NPII or aggregated information (information derived from personally-identifiable information, but not containing any personally identifying details) to Third Parties.

In the event we use Google Analytics, the information generated by the cookie about your use of the Site (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the Site, compiling reports on Site activity for us and providing other services relating to Site activity and Internet usage. Google may also transfer this information to Third Parties where required to do so by law, or where such Third Parties process the information on Google's behalf. Google will not associate your IP address with any other data held by Google.

We reserve the right at all times to: (a) use or disclose any information we reasonably believe necessary to satisfy any law, regulation, government request, court order, subpoena or other legal process; (b) edit or remove any information, in whole or in part, that in our sole discretion is objectionable, disruptive to the Site or in violation of the Terms and Conditions; (c) use and disclose any information when we believe it is necessary to prevent harm or injury, to prevent fraud, or to protect our legal interests; and (d) use and disclose any information in connection with an investigation of suspected or actual illegal activity.

If you reside in the European Economic Area or Switzerland, you may opt out of some of the disclosures described in this section by contacting us as set forth below.

5. Retention and Integrity of Information

We  retain PII and NPII for as long as necessary to fulfill the purposes outlined in this Privacy Policy, and may retain it for a longer period of time if required or permitted by law.

You can request access, modifications to, or removal of the PII collected by us through your use of the Site by contacting us using the contact point set forth below. To honor your request, we will need the exact information you want to access, modify, or remove. We  will use reasonable efforts to provide you with access to and to modify or remove such information if requested, provided, however, that we will not be liable to you should we be unable, after such efforts, to identify, modify, or remove such information. We  may also decline requests that are unreasonable, require disproportionate technical effort, or that jeopardize the privacy of others. Due to the dynamic and ever-changing nature of the interactive portions of the Site, you acknowledge and agree it may be impossible for Company to access, modify or remove your PII from these portions of the Site.

6. Children

We are committed to protecting the privacy of children. Neither we nor any of our services are designed or intended to attract children under the age of 13. We do not collect PII from any person that we know to be under the age of 13.

7. Security

We have put in place reasonably appropriate physical, electronic, and/or procedural safeguards to protect your PII. However, even with such measures, no one is able to guarantee that unauthorized Third Parties will not be able to bypass these measures or otherwise capture such information. We shall not be liable to you for any Third Party’s unauthorized access to or use of your PII.

Any information you submit using the Interactive Portions of the Site, including PII, may be automatically publicly displayed on the Site. You therefore should be very careful about providing any PII using the Interactive Portions of the Site. We are not responsible for the public disclosure of any PII you post to the Interactive Portions of the Site.

8. International Users

Information you provide may be transferred or accessed by entities around the world as described in this Privacy Policy. Company adheres to the "safe harbour” framework set forth by the US Department of Commerce which pertains to the collection, use and retention of PII collected by organizations in the European Economic Area and Switzerland[A1].

9. Do Not Track

We do not currently respond to web browser “do not track” signals or other mechanisms that provide a method to opt out of the collection of information across the networks of websites and services in which we participate. 10. Links to Other Websites

While visiting the Site, you may link to websites operated by third parties or you may have come to the Site using a link found in another website. This does not mean that we endorse these websites or the goods or services they provide. We do not make any representations or warranties about any website that may be linked to the Site. Such other websites are independent from us, and we have no control over, or responsibility for, their information, products or activities.

Our privacy practices may differ from those of these other websites. If you provide PII at one of those websites, you are subject to the privacy policy of the operator of that website, not our Privacy Policy. Please make sure you understand the other website’s privacy policy before providing PII to that other website.

11. Opt-Out

If you do not want to receive e-mails from us you may click on the “unsubscribe” link at the bottom of any email communication sent by us. Please allow us 10 business days from when the request was received to complete the removal, as some of our promotions may already have been in process before you submitted your request.

12. “Spoofing” And “Phishing”

A common Internet scam is known as “spoofing” or “phishing.” This occurs when you receive an email from what appears to be a legitimate source requesting PII from you. Please be aware that we will not send you any emails requesting you to verify credit card, bank information, or any other PII. If you ever receive an email that appears to be from us requesting such information from you, DO NOT respond to it, and DO NOT click on any links appearing in the email. Instead, please forward the email to us at info@livinghealthy.com as we will investigate instances of possible Internet fraud.

13. Your California Privacy Rights

Under California Civil Code sections 1798.83-1798.84, California residents are entitled to ask us for a notice describing what categories of PII we share with Third Parties or affiliates for the direct market purposes of such those third parties or affiliates. That notice will identify the categories of information shared and will include a list of the Third Parties and affiliates with which it was shared, along with their names and addresses.
